Content Removal and Review Procedure

Policy Overview

EliteFans LLC (“EliteFans,” “we,” “us,” or “our”) is committed to protecting the rights, privacy, dignity, and safety of individuals whose name, likeness, image, voice, or other identifying information may appear in content hosted on www.elitefans.ai (the “Platform”).

This Appeals Policy explains how an individual may request review and potential removal of content in accordance with applicable laws and platform standards.

 

1. Who May Submit an Appeal

Any individual may submit an appeal if they believe that content on the Platform identifies them, reasonably makes them recognizable, or otherwise affects their personal rights.

• The individual may be a registered user, content uploader, collaborator, or non-user.
• Appeals may be submitted regardless of whether the individual has an active account on the Platform.

2. Grounds for Appeal

An appeal may be submitted if the individual believes that:

• The content was posted without lawful authorization;
• Authorization to use the individual’s name, image, likeness, voice, or identifying information was not provided or was later withdrawn where permitted by law;
• The content misrepresents the individual or violates privacy, publicity, intellectual property, safety, or other legal rights;
• The content is being distributed without lawful permission;
• The content was uploaded using misleading, fraudulent, or inaccurate information; or
• The content violates applicable laws, the Terms of Use, or other platform policies.

3. How to Submit an Appeal

Appeals must be submitted to:

appeals@elitefans.ai

Submissions should include:

• The specific URL(s) or a clear description of the content in question;
• Proof of identity of the appealing individual;
• A statement explaining the basis for the appeal; and
• Any supporting documentation, if available.

EliteFans may request additional information necessary to:

• Verify the identity of the individual submitting the appeal;
• Assess whether the content is authorized and compliant;
• Evaluate applicable legal, privacy, safety, or platform-policy concerns.

Failure to provide sufficient information may delay or prevent review.

4. Review and Investigation Process

Upon receipt of a properly submitted appeal, EliteFans will:

• Log and acknowledge receipt of the appeal;
• Evaluate the submission for completeness;
• Temporarily restrict access to the content where appropriate;
• Conduct an internal review to assess authorization, rights, and policy compliance; and
• Notify the content uploader where appropriate and legally permissible.

EliteFans aims to review appeals within a reasonable timeframe. Complex cases may require additional time depending on available documentation and legal considerations.

EliteFans reserves sole discretion in evaluating evidence, rights, authorization, and policy compliance.

5. Outcomes of Review

Following review, EliteFans may:

• Remove the content permanently;
• Maintain a temporary restriction pending further documentation;
• Restore the content if authorization and compliance are verified;
• Suspend or terminate accounts where policy violations are identified;
• Preserve records where necessary for legal, safety, or compliance purposes; and
• Cooperate with authorities where required by law.

A determination that content complies with platform policies does not prevent the appealing party from pursuing independent legal remedies.

6. Dispute Resolution

If disagreement remains regarding the outcome of an appeal, the parties may seek resolution through a court of competent jurisdiction or other legally authorized process.

EliteFans will comply with legally binding orders issued by competent authorities.

7. Good Faith Requirement

Appeals must be submitted in good faith.

Knowingly submitting false, misleading, or fraudulent claims may result in:

• Rejection of the appeal;
• Account enforcement action, if applicable; and
• Referral to authorities where appropriate.

8. Policy Updates

EliteFans reserves the right to update this Appeals Policy as necessary to maintain compliance with applicable laws, regulatory guidance, platform standards, and operational requirements.
